Terms and Conditions
Effective Date: 1 July 2026
These Terms and Conditions ("Terms") govern your access to and use of the Drive Salem mobile application, website, and related services (collectively, the "Service") operated by Emstell Technology Consulting W.L.L. ("Company", "we", "us", or "our"). By downloading, installing, or using the Service you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. 1. Eligibility
You must be at least 18 years of age and hold a valid driving licence in Kuwait (or the jurisdiction in which you use the Service) to create an account. By accepting these Terms you represent and warrant that you meet these requirements. The Service is primarily intended for use in the GCC region; reward availability may vary by country.
2. 2. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@drivesalem.com if you suspect any unauthorised access to your account. We reserve the right to suspend or terminate accounts that contain false information or that violate these Terms.
3. 3. The Service
Drive Salem automatically detects and records your driving trips using your device's location sensors. Each trip is map-matched against posted speed limits and scored for speed-limit compliance. Scoring is governed by a versioned ruleset; the current ruleset version is always disclosed in the app. Safe-driving points ("Points") accrue in your personal ledger and may be redeemed for rewards offered by our partner network, subject to availability and these Terms.
4. 4. Points and Rewards
Points have no cash value and are not transferable, saleable, or exchangeable for cash. Points are awarded based on the ruleset version in effect at the time each trip is recorded. We may modify, suspend, or terminate the Points programme, or alter reward availability, at any time with 30 days' notice where reasonably practicable. Accrued Points expire 24 months after the last earning activity on your account. Reward redemptions are final and non-refundable once a voucher or reward code is issued.
5. 5. Data Collection and Privacy
We collect trip data — including GPS traces, speed readings, and device identifiers — solely to deliver and improve the Service. Raw GPS traces are stored securely and are not exposed in any user-facing interface or shared with third-party partners. Trip summaries (distance, score, Points earned) are accessible to you in-app. Full details about how we handle your personal data are set out in our Privacy Policy, which is incorporated into these Terms by reference.
6. 6. Acceptable Use
You agree not to: (a) manipulate, spoof, or simulate location data; (b) use automated tools or bots to generate artificial trips; (c) share your account with another person or allow others to accrue Points on your behalf; (d) attempt to reverse-engineer, decompile, or interfere with any part of the Service; (e) use the Service for any unlawful purpose; or (f) engage in any conduct that disrupts or damages the Service or harms other users. Violation of this section may result in immediate account suspension and permanent forfeiture of accrued Points.
7. 7. Intellectual Property
All content, trademarks, logos, and software comprising the Service are the exclusive property of the Company or its licensors and are protected by applicable intellectual-property laws. You are granted a limited, revocable, non-exclusive, non-transferable licence to use the Service solely for your personal, non-commercial purposes in accordance with these Terms. No other rights are granted.
8. 8. Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted or error-free. Driving safety scores are provided for informational and motivational purposes only and do not constitute professional driving advice. Drive Salem bears no liability for road traffic incidents, fines, or any other outcome arising from your driving behaviour.
9. 9. Limitation of Liability
To the fullest extent permitted by applicable law, the Company and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, revenue, data, or goodwill — arising out of or in connection with your use of or inability to use the Service. Our total aggregate liability to you for any claims under these Terms shall not exceed the greater of (a) the total value of rewards redeemed by you in the 12 months preceding the claim, or (b) KWD 10.
10. 10. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your breach of these Terms, or your violation of any third-party right.
11. 11. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Kuwait, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the Service shall first be submitted to good-faith informal negotiation. If the dispute is not resolved within 30 days, it shall be referred exclusively to the competent courts of Kuwait City, State of Kuwait.
12. 12. Changes to These Terms
We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. When we make material changes, we will revise the Effective Date above and provide notice via in-app notification or email at least 14 days before changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
13. 13. Termination
We may suspend or terminate your account and your access to the Service at any time, with or without cause, upon reasonable notice. You may delete your account at any time through the in-app Settings screen or by emailing support@drivesalem.com. Upon termination, any accrued Points and unredeemed rewards are forfeited, except where retention is required by applicable law.
